THE RIGHTS OF THE PROMOTERThe intention of the Promoter of the Competition is to make the winner responsible for the architectural services beyond preliminary design. The contract will be placed in accordance with regulations in force in Saudi Arabia with regard to architecture and engineering consultancy. The winner will be expected to make him/herself available and show evidence of all the professional skills necessary to carry out his/her task to the Promoter. The names of the architects, engineers and other consulting bodies whose collaboration he/she intend to seek will be submitted to the contracting authority for approval. The winner will be also required to associate with a Saudi company, according to rule and regulation in Saudi Arabia. All contract negotiations between the winner and the Promoter will be treated as confidential by both parties. The Promoter can insist that the winner considers the suggestions proposed by the Jury, as well the Promoter or his agents. Therefore, the awarding of the prize does not imply the obligation on the part of the Promoter to accept the proposal of the winning team in its entirety. The competition Promoter reserves the right to verify compliance with the requirements necessary to participate in the competition, and may at any time request the supply of documents probative of this, without prejudice to the statement of liability required at the time of inscription. COPYRIGHT OF THE PROPOSALS AND RIGHTS OF THE AUTHOR The compensation payable to the selected authors in both Phase One and Phase Two will imply acquisition by the Promoter of all exhibition, reproduction, and publication rights and any others that correspond, in accordance with the legislation covering intellectual copyright. The remaining participants waive the rights to the Promoter for the reproduction in any media to be used for publicizing the competition and its results. This waiver of rights becomes immediately effective on entering the competition. INCOMPATIBILITY Any individuals who do not comply with the objective of the Competition, or are deemed to be incompatible with regard to the regulations may not take part in the Competition. Persons who have taken part in the organization of the Competition or the writing of the architectural brief, persons who have been involved in the establishment or in the preparation of the program, members of Technical committees, employees of the Contracting Authority, members of their family whether ascendant, descendant or collateral, their partners or persons sharing their professional interests shall not be eligible to take part in the Competition, directly or indirectly. Members of the Jury may not be composed of individuals who have parental relationships or legal associations with any of the participants, nor did those in regular collaboration with any of the participants or those deem ideologically incompatible. |
